What An EOR Arrangement Is
Employer of Record is a commercial employment arrangement used when a foreign business needs people in Malaysia but does not yet want its own Malaysian employing entity. The local employing party becomes the legal employer for agreed employment-administration purposes while the foreign business directs the commercial work within the agreed structure. EOR is not a substitute for legal, tax or immigration analysis.
Employment Law Still Applies
Employment in Peninsular Malaysia and Labuan is subject to the Employment Act 1955 and other applicable employment rules. Employment terms, working hours, leave, termination, wage deductions and employee protections should be implemented through the actual employment relationship rather than treated as a payroll-only exercise.
Statutory Payroll And Contributions
Depending on employee status, payroll administration can involve EPF/KWSP, PERKESO/SOCSO and monthly tax deductions (PCB/MTD). EPF states that mandatory contributions for relevant non-Malaysian employees took effect from the October 2025 salary cycle; for the common non-permanent-resident category, the current schedule states 2% employer and 2% employee contributions. Employee category and current schedules must be checked before payroll is run.
Foreign Employees And Immigration
An EOR contract does not itself create a right to work in Malaysia. Foreign nationals may require the appropriate immigration permission and any sector-specific approvals before work begins. The employment, immigration and job-scope facts must be aligned.
When EOR Often Makes Sense
- Market-entry or pilot team before establishing a local subsidiary
- Small Malaysian team supporting a foreign headquarters
- Sourcing, sales or operational personnel while the group tests the market
- Transitional period while a Malaysian entity or licence is being established
When Your Own Malaysian Entity May Be Better
- Headcount is growing materially
- The business will sign significant local contracts
- Local licensing or tax registration is central to the business
- A long-term Malaysian operating presence is expected
- Customers or banks require a Malaysian contracting entity
